To safeguard it effectively, we are providing you with this privacy policy statement, which contains information regarding the type of data collected online and the various ways you can manage the collection and use of these data on the website.

This privacy policy statement is provided pursuant to Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decrees No. 196/2003 – Personal Data Protection Code and No. 201 of 6/12/2011, to all those who interact with the Optimum – Quality on Top web services, accessible online at the address http://www.optimumsurfaces.com, which is the home page of the official website of Optimum – Quality on Top.

Your data will be processed in compliance with current European and Italian data protection laws and with the specific local regulations applicable in each case for processing performed outside Italy, as well as with the principles and general rules of conduct contained in the Optimum – Quality on Top Code of Ethics.

1. Types of data processed and their sources.

1.1 Data acquired automatically

The software procedures used to operate the website acquire some personal data, the transmission of which is implicit in the use of Internet communications protocols, and save them in log files. These data are not collected for association with identified data subjects, but by their very nature, when processed or associated with data held by third parties, might allow users to be identified. This category includes the IP addresses or domain names of the computers used by users connecting to the site, the addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used when submitting the request to the server, the size of the file obtained in reply, the numerical code indicating the server’s response status (concluded successfully, error, etc.) and other parameters relating to the user’s operating system and IT environment, starting and destination pages, browsing index and identifying behaviours while viewing the site’s pages. These data are used for the sole purpose of obtaining anonymous statistical information concerning use of the site and to check that it is operating correctly. The data may be used to identify those responsible in the event of computer crime against the site, only on the request of the relevant supervisory authorities.

1.2 Data provided voluntarily by the user

The optional, explicit, and voluntary transmission of email to the addresses indicated on this site results in the subsequent acquisition of the sender’s address, necessary in order to reply to the enquiry, and any other personal data included in the message. Optimum – Quality on Top collects and processes the personal data provided directly and voluntarily by you when you register on the site and/or subscribe to Optimum – Quality on Top’s newsletter, and/or when you submit a request to our Customer Service, together with any data supplied when filling in the customer form. These data include, for example, your full name, postal address, email address and telephone number. Moreover, the optional, explicit and voluntary sending of emails via the site and/or to the addresses indicated on the site entails the subsequent acquisition of the sender’s address, which is necessary to reply to requests, as well as any other personal data included in the message sent.

2. Cookies

The only cookies used on the site are technical cookies, used to enable browsing or to provide a service requested by the user. They are not used for any further purposes and are installed directly by the site’s owner in accordance with Article 122(1) of the Italian Data Protection Law (in its current wording, introduced by Legislative Decree 69/2012). Technical cookies may also be used without the consent of the data subject.

In its Opinion 04/2012 (WP194) on Cookie Consent Exemption, the European body to which the Data Protection Authorities of the Member States belong (the Article 29 Working Party) rules that it is not necessary to acquire the user’s prior, informed consent for the following types of cookies:

  • user-input (session identifier) cookies with a lifespan of one session, or persistent cookies with a lifespan of only a few hours in some cases;
  • authentication cookies, used for the purposes of authenticated services, with a lifespan of one session;
  • user-centric security cookies, used to detect authentication abuses, with a limited persistent lifespan;
  • multimedia player session cookies, such as “flash” player cookies, with a lifespan of one session;
  • load balancing session cookies, with a lifespan of one session;
  • persistent cookies for customising the user interface, lasting one session (or slightly longer).

All other types of cookie are only used after having obtained the user’s consent, which can be changed or revoked at any time while browsing the site.

3. Purposes of the data processing

Personal data may be used to respond to and satisfy all your requests and thus to manage your relationship with Optimum – Quality on Top. The processing of data for this purpose is compulsory and any failure to provide, or inaccurate provision of any information may restrict and/or prevent full use of the functions and services available on the site.

4. Where and how data are processed.

Personal Data will be processed using appropriate electronic or other automated, computerised and online tools, or using manual, paper-based methods, applying criteria strictly related to the purposes for which the personal data were collected, and in all cases in a manner which ensures their security and confidentiality. The personal data will be processed by in-house staff of Optimum – Quality on Top specifically authorised as Data Processors as part of their duties, and in some cases by external parties as necessary and/or useful for the execution of the aforesaid purposes (e.g. service providers, IT service maintenance technicians, companies used by Optimum – Quality on Top for the creation and/or management of marketing campaigns for its products or services, etc.).

Processing of data in relation to web services takes place at the Data Controller’s offices and on the premises of the provider Ventisette Digital Via dei Servi 22, 41124 Modena – Italy.

5. Optional nature of data provision.

The provision of personal data is optional. However, if you wish to contact our Customer Service, you must fill in all the fields marked as compulsory in the relative forms. Your data cannot be processed for the purposes referred to in point 3 unless you give your specific consent. If you do not give your consent, the only effect will be that we will be unable to inform you regarding initiatives which might be of interest to you, and/or to send you any other marketing information about Optimum – Quality on Top’s products, initiatives and events. You may withdraw your consent at any time by writing to Optimum – Quality on Top, Via Magazzeno, 1944, Savignano sul Panaro (Modena) or by sending an email to [email protected].

6. Disclosure and dissemination of data.

As far as is necessary and/or useful for the execution of the aforesaid purposes, your personal data may be processed by external parties acting as Data Processors, in the following categories:

  • Companies affiliated with Optimum – Quality on Top;
  • Professional firms, consultants and companies that provide support and/or consulting services, or that perform services related to and useful for the purposes of the data processing on behalf of Optimum – Quality on Top.

Your data may be transferred abroad in compliance with the relevant legal provisions, including to countries outside the European Union, where the Company pursues its interests. Personal data will not be used for third-party marketing operations and in no case will they be disseminated to unspecified parties.

7. Newsletter

On subscription to the Optimum – Quality on Top newsletter, the user’s name and email address are added to a list of contacts to whom sales and marketing information is periodically sent. In order to subscribe to the newsletter, users must be at least 16 years of age and must provide their specific consent. Subscription to the newsletter is not possible without consent to communications.

Optimum – Quality on Top receives an email with the aforesaid data on subscription to and unsubscription from the newsletter, and it periodically backs up its distribution list.

The newsletter service is provided by The Rocket Science Group, with registered office in 675 Ponce de Leon Ave NE, Suite 5000 Atlanta, GA 30308 United States. Like all newsletter platforms, The Rocket Science Group provides information about who opens the newsletter and clicks the links. Contact personal data are stored on their servers. To unsubscribe at any time, users need only click on the link at the bottom of each email.

8. Data Controller.

The Data Controller is Ceramica del Conca S.p.A. with registered office at Via Croce 8 San Clemente (Rimini), which will process your data in compliance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003, as amended – Personal Data Protection Code.

You may exercise your rights under articles 15-22 of the Regulation at any time.
